This website ("Website") is owned by WORLDIDE EXPRESS REMITTANCE PTY LTD (ABN 628259950) trading as Weremit ("Weremit"). This web page represents a legal document that serves as our Terms of Service and it governs the legal terms of our website, sub-domains, and any associated web-based and mobile applications (collectively, "Website"), as owned and operated by Weremit.

PLEASE READ THE FOLLOWING TERMS AND CONDITIONS CAREFULLY. BY ACCESSING THE WEBSITE, YOU ACKNOWLEDGE THAT YOU HAVE READ THEM AND THAT YOU AGREE TO BE BOUND BY THEM, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site.

Governing Law

Any claim relating to WEREMIT's Website shall be governed by the laws of Australia without regard to its conflict of law provisions, and You consent to exclusive jurisdiction and venue in such courts.

Definitions

The terms "us" or "we" or "our" refers to WEREMIT, the owner of the Website.

A "Visitor" is someone who merely browses our Website, but has not registered as Member.

A "Member" is an individual that has registered with us to use our Service.

Our "Service" represents the collective functionality and features as offered through our Website to our Members.

A "User" is a collective identifier that refers to either a Visitor or a Member.

All text, information, graphics, audio, video, and data offered through our Website are collectively known as our "Content".

"App" means Weremit's mobile application for executing the transfer of funds from one country to another.

"Business Day" means any day on which we are open for business for the execution of fund transfers from one country to another.

"Destination Country" means the country in which the Payee receives money through the Service.

"Fees" means Weremit's fee plus any additional charges or Local Taxes applicable to each Transaction, which Weremit may charge in its sole discretion in accordance with applicable laws, as may be described on the Weremit website from time to time.

"Local Taxes" means any taxes or charges payable in the Destination Country.

"Order" means a request for fund transfer.

"Payee" means someone who receives money through the Service.

"Payment Instrument" means a valid instrument of payment such as a bank account, debit card or credit card.

"Payment Request" means a specific instruction from you to a Sender requesting a Transaction.

"Payout Amount" means the amount paid out, after any foreign exchange conversion, to the Payee's account exclusive of the Service Fee.

"Bank Priority" is a type of bank to bank transfer via the SWIFT network completed within 24 hours.

"Recipient" means:
(a) a Payee; or
(b) in the event that you are using the Service to send a Payment Request, someone who receives the Payment Request.

"Registration" means the registration details of the customer as updated from time to time.

"Bank Regular" is a type of bank to bank transfer via the local payment network completed within 1-3 days.

"Sender" means someone who uses the Service to send funds.

"Service Provider" means a local bank, money exchange house, or other third party service providers in the Destination Country with whom Weremit works to provide the Service.

"Transaction" means the transfer of funds through the Service.

"Transaction Amount" means the amount of money that the Sender wishes to send to the Payee as a Transaction, excluding any applicable Service Fee and prior to any foreign exchange conversion.

"Transaction History" means the record of your Transactions on our website which you may access using your email and password registration details.

"Transaction Request" means a specific instruction from you requesting us to send money to a Payee through the Service.

"Verified" means that you have completed our verification process in order to help establish your identity with Weremit.

"2FA Enabled" is a two-step verification or an extra layer of security that prevents hackers from getting access to a member's account. Weremit members can enable or disable two-factor authentication via their account settings.

Website Information

The materials appearing on Weremit's Website could include technical, typographical, or photographic errors. Weremit does not warrant that any of the materials on its Website are accurate, complete, or current. Weremit may make changes to the materials contained on its Website at any time without notice. Weremit does not, however, make any commitment to update the materials.

Member's Account Dashboard

If you register an account with Weremit, you will be able to obtain a username and password with unlimited or prescribed levels of authority in order to enable you and your authorised representatives access to the Member's Account Dashboard ("MAD") and use the Services. The "MAD" allows you to book transactions, enter beneficiary account details and access information about your account online (collectively "the Services").

You are accountable for maintaining the confidentiality of your account and password and you accept responsibility for all activities that happen under your account and password. Weremit will not check the identity of the user every time the username and password are used. It is your responsibility to ensure the security of your username and password. Weremit will be entitled to assume that anybody who uses the username and password has your full authority to do so and accepts no responsibility for misuse or unauthorised access unless you have notified Weremit in accordance with this Agreement.

Service Level Agreement

The main business for Weremit is the provision of remittance services to an individual or a business or the transfer of money by an individual or business from one country to another.

Weremit will use all reasonable efforts to provide access to the Website at all reasonable times, but cannot guarantee that such access will never be interrupted as a result of technical or other unforeseen problems.

You agree to use the Website only for legitimate purposes. You agree not to interfere with, damage (or attempt to interfere with or damage) or reverse-engineer any code, data or software on or associated with the Website. You agree to access the "MAD" only in accordance with the terms of any client agreement you enter into with Weremit.

Subject to any conditions and warranties implied by legislation and to the terms of the client agreement you have with us, Weremit excludes liability for any delay, interruption or unavailability of the Website. You acknowledge that we operate an online remittance platform that could be subject to technical, or other, problems, the nature and duration of which may be beyond our control. Our Service also involves the use of intermediaries who are outside our control.

Any Services provided to you will be provided only pursuant to Weremit's standard client agreement which you must agree to in addition to this agreement and prior to the provision of any such Services. In the event of any inconsistency between this Agreement and the relevant client agreement, the provisions of the client agreement will prevail.

Restrictions

The copyright in the Website and all associated material is the property of Weremit or third parties from whom the material has been licensed. By accessing or using the Website, Weremit grants you a limited licence to view and otherwise access content on the Website, but you are not authorised to use such content or source code for any other purposes, including reverse engineering or copying that content or source code, unless otherwise specified. All other rights are reserved, and, except as outlined in this agreement or as otherwise permitted by the Copyright Act 1968, no part of the Website and associated material may be reproduced or published in any form or by any means, electronic or mechanical, including photocopying, recording, or by information storage or retrieval system, without the prior written permission of Weremit.

Eligibility

To be eligible for our Services, you must be at least 18 years old. You further represent and warrant to us that if you are an individual and you open an Account with us that you are not acting on behalf of an undisclosed principal or a third party beneficiary.

Before being able to use the Service we have to perform mandatory customer verification. For that we may ask for photographic evidence of your identity such as a copy of your passport. It is possible to provide this evidence through a number of methods including fax and email.

Weremit reserves the right to access various government and private databases so as to verify your information (so called "electronic identification") If certain databases provide a match to the information you provide then we may not have to ask for photographic evidence of your identity.

Weremit reserves the right to refuse to accept any new user or any transaction at its discretion.

Exchange Rates & Fees

Weremit rates are published on the website 24/7. The contracted rate is ONLY final and binding at the time of placing an order; when payment is made via the Member's Account Dashboard and funds are received in Weremit bank account. Should a change of exchange rate occurs between the time of placing the order and the time customer's funds are received in Weremit bank account, the customer will get a notification from Weremit to approve or cancel the transfer.

Weremit charges a fee on every payment. Fees relating to each payment are visible to the user before submitting the payment.

Administration charges may only incur when our settlement banks or the receiving bank refuse your transaction due to incorrect payment details, their regulatory requirements or any other valid reason. Any administrative charges from the settlement banks or the receiving banks will be deducted from your payment amount. Any such case that is known to us beforehand will be communicated on the website before an order is completed.

Security

Weremit employs secure encryption technology, but cannot guarantee that the Website will always be free of viruses or bugs or that any communication between you and the Website is secure from interception by third parties.

You should check the account records of your online Weremit account carefully and promptly report to us as soon as you become aware of any payments that you think are errors or are payments that you did not authorise or you think were made by someone else without your permission.

Incorrect Transaction

You must notify us promptly if you become aware that you have made a mistake while making a transaction online or if you become aware of any delays or mistakes in processing your transactions on the part of Weremit. If your funds are sent to the wrong account as the result of a mistake made by you, and we have acted in accordance with your instructions, we will be under no obligation either to recover the funds or to resend the funds to the correct beneficiary account. You will need to book a new transaction.

Cancellation of Transaction

Cancellation of transaction in not allowed.

Membership Termination

You may terminate your access to the "MAD" at any time by giving us 48 hours written notice by email of your intention to change or terminate your username and password. In the event that you suspect that any person has gained access to your username and password without your authorisation, you should contact us immediately on the telephone number on this Website.

Electronic Communication

You are connecting with us electronically when you go to the Website or send out emails to us. You consent to get interactions from us online. We will connect with you by email or by uploading notifications on the Site.

The Service does not allow for Communications to be provided in paper format or through other non-electronic means. You may withdraw your consent to receive Communications electronically, but if you do, your use of the Service shall be terminated. In order to withdraw your consent, you must reach out to us via the Contact Us page.

Likewise, you must promptly update us with any change in your email address via the Contact Us page.

Legal Compliance

You agree to comply with all applicable domestic and international laws, statutes, ordinances, and regulations regarding your use of our Website. Weremit reserves the right to investigate complaints or reported violations of our Legal Terms and to take any action we deem appropriate, including but not limited to cancelling your Member account, reporting any suspected unlawful activity to law enforcement officials, regulators, or other third parties and disclosing any information necessary or appropriate to such persons or entities relating to your profile, email addresses, usage history, posted materials, IP addresses and traffic information, as allowed under our Privacy Policy.

Intellectual Property

Our Website may contain our service marks or trademarks as well as those of our affiliates or other companies, in the form of words, graphics, and logos. Your use of our Website does not constitute any right or license for you to use such service marks/trademarks, without the prior written permission of the corresponding service mark/trademark owner. Our Website is also protected under international copyright laws. The copying, redistribution, use or publication by you of any portion of our Website is strictly prohibited. Your use of our Website does not grant you ownership rights of any kind in our Website.

The Website may contain links to other websites which are not maintained or controlled by Weremit ("third party site"). Weremit makes no representations or warranties whatsoever about any third party site. The Website provides these links as a convenience only. A link does not constitute any endorsement of, sponsorship of, or affiliation, or recommendation with the linked site. Weremit accepts no responsibility for the content or use of any third party site. If you link to any third party site, you leave the Website and do so entirely at your own risk.

Website Modifications

Weremit reserves the right to alter without notice the content, appearance and Services offered on the Website, provided always that, in the event of any inconsistency, the terms of the client agreement that you enter into with Weremit shall prevail.

Indemnity

You fully indemnify and hold harmless Weremit and its officers, employees and agents in respect of any loss, damage, cost or expense which they may sustain or incur arising from or related to the improper use of the Website by you or your authorised representatives.

General Terms

Our Legal Terms shall be treated as though it were executed and performed in Australia and shall be governed by and construed in accordance with the laws of Australia without regard to conflict of law principles. In addition, you agree to submit to the personal jurisdiction and venue of such courts. Any cause of action by you with respect to our Website, must be instituted within one (1) year after the cause of action arose or be forever waived and barred. Should any part of our Legal Terms be held invalid or unenforceable, that portion shall be construed consistent with applicable law and the remaining portions shall remain in full force and effect. To the extent that any Content in our Website conflicts or is inconsistent with our Legal Terms, our Legal Terms shall take precedence. Our failure to enforce any provision of our Legal Terms shall not be deemed a waiver of such provision nor of the right to enforce such provision. The rights of Weremit under our Legal Terms shall survive the termination of our Legal Terms.
